1. Acceptance of Terms
By accessing or using the darrigo.design website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. Services
darrigo.design provides web design, web development, digital marketing, creative services, and AI development services. Specific deliverables, timelines, payment terms, and revision limits are defined in individual project agreements (statements of work or proposals) agreed upon before work begins. These Terms of Service govern general use of the website and any communications with us prior to a formal agreement.
3. Intellectual Property
Upon receipt of full payment for a completed project, ownership of all custom design assets and code created specifically for that project transfers to the client. We retain the right to display completed work in our portfolio unless expressly agreed otherwise in writing. We retain ownership of any proprietary tools, frameworks, libraries, or processes developed independently that may be used in the delivery of your project.
4. Client Responsibilities
You are responsible for providing accurate, complete, and timely content, feedback, and approvals required for project delivery. Delays caused by late client responses may affect delivery timelines and could result in revised project schedules. You warrant that any content, images, or materials you supply do not infringe any third-party intellectual property rights.
5. Payment
Payment terms are specified in each project proposal. Unless otherwise agreed, a deposit is required before work begins, with the balance due upon project completion. Outstanding invoices beyond 14 days of the due date may result in work being paused until payment is received.
6. Limitation of Liability
darrigo.design's total liability for any claim arising from services provided shall not exceed the total amount paid by the client for the project in question. We are not liable for indirect, incidental, or consequential damages, including loss of revenue or data, even if advised of the possibility of such damages.
7. Website Use
You may not use this website for any unlawful purpose, to distribute malware, or to attempt unauthorised access to any server or system. We reserve the right to block access to the site for any user who violates these terms.
8. Governing Law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.
9. Changes to These Terms
We reserve the right to update these terms at any time. Changes will be noted with a revised date at the top of this page. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
